A Trust or Will, which is for me?

Like most attorneys we will say it depends on your specific situation... However, wills typically need to proceed through the probate process, while trusts typically are private and do not require probate. The costs for these services differ depending on each situation. At Private Path we offer our estate planning services at a flat fee discussed at our initial meeting. 

What is estate planning?

Estate planning involves organizing your affairs and preparing for the management of your assets in the event of your incapacity or death. It can also include planning for those times when you are incapacitated. 

Who will care for my/our children if something happens?

This is a good question to always ask. Children can be a big point of contention in your family,especially if your wishes are not legally binding. There is also the possibility of the government or courts stepping in and putting your children in a home (adoption, foster care, wrong family member, etc.) that will not pass on your values. An estate plan with guardianship designation can keep this from happening to your family. 

Why is an estate plan important?

An good estate plan ensures that your wishes are followed regarding the distribution of your estate and the care of any minor children. It can also provide protections of any legacy left to those you leave behind. 

I'm young do I need an estate plan?

Yes... you definitely need an estate plan. Unfortunately bad things happen, even to really young people. It will be a burden on someone to deal with your estate if something happens. Additionally, the right estate plan can help even if you do not die, but are incapacitated.
